These terms, together with any entry information apply to this competition. These Terms are a contract between each entrant (you) and Maritime New Zealand. By entering the competition each entrant will be deemed to have accepted these terms and conditions and to have agreed to be bound by them.
- Term: The Competition starts on 21 October 2024 and finishes 25 November 2024 on the dates specified by Maritime New Zealand at the time of entry. If your entry is received outside of this period you may be disqualified.
- Prize: The prize(s) for the Competition are not transferable or redeemable for cash. Some or all components of the prizes may be subject to availability, as well as additional terms and conditions set by third parties. Prize winners are responsible for arranging and paying for all costs associated with the prize that are not explicitly stated by Maritime New Zealand at the time of entry. Maritime New Zealand may replace the prize with another prize of equivalent or greater value if the prize becomes unavailable for reasons outside of Maritime New Zealand’s reasonable control.
- Delivery of prizes: Where the prize is to be delivered to the winner, the prize must be delivered to a New Zealand address. Maritime New Zealand makes no warranties about the prize (including as to its quality or fitness for purpose). Maritime New Zealand is not liable for damage to prizes sent by post or courier.
- Who may enter: The competition is open to New Zealand Residents only. Maritime NZ reserves the right to exclude any person from participating in the competition on reasonable grounds. To enter the Competition, you must meet any entry criteria specified by Maritime New Zealand, and comply with these Terms.
- How to enter: If you do not follow the entry instructions specified by Maritime New Zealand and otherwise comply with these Terms, you may be disqualified. Incomplete entries may not be accepted. Generally, entries may not be modified after submission. An individual is setting this deal up for an acquaintance and therefore should seek permission from that member before entering their details.
- Number of entries: Unless otherwise specified, you may only enter the Competition once.
- Winners: Unless otherwise specified, the winners will be drawn randomly from one prize pool comprising all valid entries on the date specified by Maritime New Zealand at the time of entry. Entrants will not win more than one prize. Competition winner announced 9 December 2024.
- Contacting the winner: The winner of the Competition will be announced after determination. Maritime New Zealand will take reasonable steps to contact the winner by using the contact details provided at the time of entry. If Maritime New Zealand cannot contact a winner within one week after the winner is announced or if the winner is otherwise unable to accept the prize, then the winner will forfeit the prize and Maritime New Zealand may select a new winner.
- Entries: All entries received by Maritime New Zealand and any materials submitted with the entry (Materials) will become the property of Maritime New Zealand. By entering the Competition you consent to Maritime New Zealand copying, reproducing, altering, communicating to the public and otherwise using your entry and any Materials all media, whether known now or developed in the future, in relation to the Competition, or to advertise and promote Maritime New Zealand including by publishing your entry and or the Materials, or parts of them, on Maritime New Zealand’s website(s).
- Publication of winners: By entering the competition, winners agree to their names being published and as applicable to be photographed and/or interviewed by Maritime New Zealand or any third party provider and that Maritime New Zealand or that provider may use their names and such photographs and/or interviews for publicity purposes.
- Privacy: Maritime New Zealand may collect and use personal information about you (including your name, contact details, and any other personal information you provide in connection with your entry) for the purpose of administering the Competition, verifying the validity of entries, contacting winners and checking winners' identities, and marketing the goods and services of Maritime New Zealand to you. As certain information is required for us to run the Competition effectively, if you do not provide accurate information where we request, you may be disqualified from the Competition. Under the Privacy Act 2020 and in accordance with Maritime New Zealand’s Privacy Policy, personal information is only collected, stored and used for the purposes of selecting the competition winners and notifying them of their prize.
- Liability: Subject to any applicable law that cannot be excluded, Maritime New Zealand and its employees and agents will not be liable for any loss or damage (whether in contract, tort (including negligence), under statute, equity or otherwise in connection with the Competition or the prize(s)). Without limiting the previous sentence, Maritime New Zealand is not responsible for any late, misdirected or incorrectly completed entries, or any technical malfunction, delay or loss of data that occurs in the course of the administration of the Competition, however caused.
- Facebook: Where the Competition is promoted via Facebook, the Competition is not associated with Facebook (Meta Platforms, Inc), Meta Platforms, Inc has no liability in connection with the Competition, and any information you provide in connection with the Competition is provided to Maritime New Zealand, not to Meta Platforms, Inc. Our competition is in no way sponsored, endorsed or administered by, or associated with any social media platform on which they are published.
- Legal status of ‘Designed Contract’: For the purpose of clarity, it is expressly stated that the arrangement denoted as the ‘Designed Contract,’ formed through the utilization of the ‘Create your deal’ online form by the two parties, is devoid of legal enforceability. It is explicitly stipulated that said arrangement is undertaken strictly for recreational or amusement purposes and does not give rise to legal obligations or consequences for the participants involved or Maritime New Zealand.
- General: Maritime New Zealand reserves the right to refuse to award any prize to an entrant who, in its sole discretion, has violated these terms, gained unfair advantage in participating in the competition, or won using fraudulent means. Additionally, Maritime New Zealand's decisions regarding the Competition are final, and no correspondence will be entered into. The organization also reserves the right to change these Terms at any time and may cancel the Competition if it cannot reasonably run as planned for any reason.
